Rules your software must follow in the Netherlands

Tax, e-invoicing, data-protection and AI rules that shape an ERP, billing system or AI agent in the Netherlands. Last reviewed October 2026.

Indirect taxVAT (btw), standard rate 21%Standard rate 21% with a 9% reduced rate (accommodation moved to 21% from 2026); most businesses file quarterly VAT returns with the Belastingdienst. Domestic reverse charge applies in sectors such as construction subcontracting, so invoicing software must support reverse-charge wording.
E-invoicingVoluntary · Peppol BIS / NLCIUS (EN 16931) for B2GB2B e-invoicing is voluntary and PDF invoices remain valid, while e-invoicing via Peppol has been mandatory for suppliers to central government since 2017 and is required across most of the public sector. The government has been exploring a domestic Peppol-based B2B mandate aligned with ViDA, but no start date has been legislated.
Data protectionGDPR plus the GDPR Implementation Act (Uitvoeringswet AVG, UAVG)GDPR applies directly, supplemented by the GDPR Implementation Act (Uitvoeringswet AVG, UAVG) and supervised by the Autoriteit Persoonsgegevens (AP); B2B buyers expect an Art. 28 data processing agreement, a sub-processor list and, in practice, EU/EEA hosting or SCC-covered transfers.
AI rulesThe EU AI Act applies directly: prohibited AI practices have been banned since 2 Feb 2025, general-purpose AI model rules apply since 2 Aug 2025 and transparency duties (e.g. chatbot disclosure, AI-content labelling) since 2 Aug 2026, while the Digital Omnibus on AI (in force 27 Jul 2026) moved stand-alone high-risk (Annex III) obligations to 2 Dec 2027 and product-embedded high-risk (Annex I) obligations to 2 Aug 2028; the Netherlands is using a decentralised model of sector supervisors with the RDI (Rijksinspectie Digitale Infrastructuur) as single point of contact.
Systems we migrate from or connect toExact Online, Twinfield, AFAS, Moneybird, SnelStart, e-Boekhouden.nl, OdooMasters, ledgers, stock and open balances move across and are reconciled before cutover.
Payment rails for web apps and SaaSiDEAL (migrating to Wero), SEPA Direct Debit, Mollie, Adyen, Stripe, Klarna
Also worth knowingTax records must be kept for 7 years, and accountants and auditors expect the XAF (XML Auditfile Financieel) export from bookkeeping software. Peppol is already widely used for B2B exchange even without a mandate.

General information, not legal or tax advice. Rules change, so we confirm current requirements during discovery; your tax adviser should confirm anything that affects filings.

05 — FAQ

Custom software in the Netherlands: common questions

Do you work with businesses in the Netherlands?

Yes. Flip Retail is based in Jaipur, India, and works with Netherlands businesses remotely. We have no office in the Netherlands; discovery happens on video calls, you get working software every two weeks, and the engineers who write the code are on the calls.

Can a custom ERP handle VAT and e-invoicing in the Netherlands?

Yes. Invoicing is built for the Netherlands's VAT (standard rate 21%). B2B e-invoicing is voluntary and PDF invoices remain valid, while e-invoicing via Peppol has been mandatory for suppliers to central government since 2017 and is required across most of the public sector. The government has been exploring a domestic Peppol-based B2B mandate aligned with ViDA, but no start date has been legislated. If you or your customers want it, a custom ERP can connect to Peppol BIS / NLCIUS through an accredited provider.

How do you handle GDPR?

GDPR applies directly, supplemented by the GDPR Implementation Act (Uitvoeringswet AVG, UAVG) and supervised by the Autoriteit Persoonsgegevens (AP); B2B buyers expect an Art. 28 data processing agreement, a sub-processor list and, in practice, EU/EEA hosting or SCC-covered transfers. You choose where the system is hosted, access is role-based, and we work on test or masked data during development wherever possible.

Can you migrate us from Exact Online, Twinfield or AFAS?

Yes. Masters, ledgers, stock items and opening balances move across and are reconciled with your accountant before cutover, ideally at a year-end or quarter-end.

Are there AI rules we need to follow in the Netherlands?

The EU AI Act applies directly: prohibited AI practices have been banned since 2 Feb 2025, general-purpose AI model rules apply since 2 Aug 2025 and transparency duties (e.g. chatbot disclosure, AI-content labelling) since 2 Aug 2026, while the Digital Omnibus on AI (in force 27 Jul 2026) moved stand-alone high-risk (Annex III) obligations to 2 Dec 2027 and product-embedded high-risk (Annex I) obligations to 2 Aug 2028; the Netherlands is using a decentralised model of sector supervisors with the RDI (Rijksinspectie Digitale Infrastructuur) as single point of contact. We design AI agents with logging, human oversight and clear disclosure from the start, which covers most current requirements.
